This page (and any other documents that are referred to on it) contains the Terms and Conditions under which we supply any of the products listed on our website https://www.maxicoffee.com/en-gb/ ("our website") to you.

Please read these Terms and Conditions carefully before ordering any products from our website. You should be aware that by ordering any of our products, you agree to be bound by these Terms and Conditions. If you have any questions or feel unsure about any of the content, please contact our Customer Service before placing an order. Print the Terms and keep a copy of them for your reference.

We have written these T&C's with the consumer in mind and have tried to make them as easy to understand as possible. To further enhance your understanding of the terms, we have listed some words that are widely used throughout the document.

Here is the terminology :

  • Contract - means any purchase of items from our site between us and you for which these T&C's are used for.
  • Conditions - means the standard T&C's of the sale, including the Returns Policy and any special terms and conditions confirmed in writing by us.
  • Goods - means the products or services which we have sold to you in accordance with our T&C's.
  • "We" means MaxiCoffee and "us" and "our" shall hold the same meaning.
 

 

Within these T&C's we shall use headers to aid your understanding of the document.

These Terms apply to our information and offer to you, the agreement between us and any related communication. We may change our Terms and Conditions at any time, so please do not assume that the same terms will apply to future orders.

In the event of any of these Terms and Conditions being invalid or unenforceable, the remainder of these Terms and Conditions will remain in place. No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms and Conditions that is caused by events outside our reasonable control which includes any strikes, civil commotion, terrorist attack or threat of terrorist attack, fire, explosion, flood, other natural disaster, impossibility to use public or private transports, impossibility to use public or private telecommunications networks or any acts, decrees, legislation, regulations or restrictions of any government.

If any of these Terms and Conditions are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

These Terms and Conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

We each acknowledge that, in entering into a contract, neither of us has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between us prior to such contract except as expressly stated in these terms and conditions.

Neither of us shall have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of any Contract (unless such untrue statement was made fraudulently) and the other party's only remedy shall be for breach of contract as provided in these terms and conditions.

Any transaction you enter into with us through our website is entered into with, our legal entity SAS MaxiCoffee.com which owns the MaxiCoffee brand and owns and operates this website. Our official company address is: 25 rue Galeben, 33380 Mios, France. Our VAT number is 303 0579 38 for the UK, IE 3566469SH for Ireland and our company is registered with the Chamber of Commerce office in Paris, France under registration number 493 361 182.

Accessing our website means that you automatically agree to our Terms and Conditions. If you do not agree with them, then please do not use our website and leave it . Our website is provided to you for your personal use only.

If you choose to access this website from outside the UK, you are responsible for compliance with local laws if and to the extent local laws are applicable. We have made every effort to display the products as accurately as possible but cannot guarantee that the product images you see displayed on your screen are a totally accurate representation of the actual merchandise. This is due to the possible technical differences in monitors or screens you may use, amongst other reasons.

By placing an order through our website, you confirm that you are legally capable of entering into binding contracts, that the personal information you provide when you register as a customer and when you place an order is true, accurate, current and complete in all aspects, and that you do not impersonate anyone else.

We don't guarantee that the website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represent the full functionality, accuracy, and reliability of the website.

We may provide links to other websites but, if you follow these links, you acknowledge and agree that we are not responsible for the availability or content or privacy practices of such external sites. As part of our effort to make further improvements to our services, we call our customers and those phone calls with and by us may be recorded or monitored. We also may monitor incoming and outgoing emails. Our employees and agents are not authorised to make any representations concerning the goods unless confirmed first by us to you in writing.

When placing an order with us, you acknowledge that you have not relied on any such representationsthat are not confirmed. All specifications, drawings, particulars about weights, sizes and performance issued by us are approximate only.

When you place an order with us, you are making an offer to buy goods. After receipt of your order, we will send you an order acknowledgment email detailing the products and prices. If you do not receive such an email within 24hrs of placing your order, please contact our Customer Services.

The order acknowledgment email is an acceptance of your order. Acceptance of your order and formation of the contract will only take place once we have confirmed your card authorisation for your order. This will be displayed on your screen at the time of payment confirmation. We will send you a dispatch confirmation email, along with the parcel(s) tracking number(s), when the products you have ordered have left our warehouse. If your order has not been accepted, you will receive an email from us telling you the reasons why.

In the unlikely event that the goods are no longer available, or that we have made a pricing mistake, we will advise you of this. You will then not receive an e-mail acknowledging your order and there will be no contract between us.

All prices shown in the website are in pounds sterling, and inclusive of the VAT (at different rates). Where applicable, VAT may change from time to time. In case we use a special sale offer price, please note that this might be a limited period offer which we will then indicated.

We take great care in providing you with the right product information and prices. In the unlikely case that an error in pricing appears in goods that you have ordered, we will inform you as soon as possible. However, we shall be under no obligation to fulfil an order for a product that was shown at an incorrect price. In such a case, we will contact you by email.

Price reduction and comparison price advertisement

For any price reduction advertisement of a product displayed on the website, the reference price, referred to as the "last price", corresponds by default to the lowest previous price displayed by MAXICOFFEE ONLINE with regard to all consumers on the website, during the last thirty (30) days preceding the advertisement of the price reduction.

MAXICOFFEE ONLINE may have to mention, independently of any possible price reduction, a "comparison price" on some products offered on the website. The term “comparison price” will correspond to one of the following prices:

The brand/manufacturer's suggested retail price (MSRP) : price at which the manufacturer or its official representative (importer, distributor,etc) recommend to sell its product. This price is updated when the manufacturer or its official representative communicates a new suggested retail price for the its product.

Competitors’ price : selling price of a product taken from a panel of at least two ecommerce websites competing with MAXICOFFEE ONLINE.

Price per unit : this price refers to the unit price of a product when bought outside of a bundle.

We offer delivery within the United Kingdom(including Shetland, Orkney and Hebrides islands) and the Republic of Ireland. The place of delivery is deemed to be the shipping/delivery address that you provide in your order.
We do not deliver to Jersey - Guernsey - Isle of Man - Falkland Islands - Gibraltar -Turks and Caicos Islands - South Georgia and the South - Sandwich Islands - Pitcairn Islands - British Indian Ocean Territory - British Antarctic Territory - Tristan da Cunha - Saint Helena - Ascension Island - Anguilla.
For orders under £49, there will be a standard delivery charge of £6.99 to single UK addresses. For orders over £49, we offer free delivery to single UK addresses. All the details are available at anytime on our Delivery Policy page . In case of additional fees, they will be stated on the shipping options page at the time of checkout.

Delivery will be carried out with either DHL or DPD.

We accept both debit and credits cards including CB, Visa, Mastercard, and Bank Transfer. We take payment from your card at the time your order is placed. Credit card payments will be processed using Dalenys. Payments will show as MaxiCoffee on your bank statement.

All credit card and debit card holders are subject to validity checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.

If an item sells out and is no longer available, we will take it off display as soon as possible. If you have ordered a product that goes offline, you may be offered different options such as switching to another equivalent product (based on price and the nature of the product), or a full refund.

If an item is out of stock on our website at the time of placing your order but will be available at some point in the future, we will clearly display this information on the product page with, if possible, an estimate date of shipping based on our supplier information. Your order will remain active and you will be emailed with regular stock updates. During that time, you will be able to cancel your order at no extra cost.

If an offer is subject to a limited period of availability or is made subject to conditions, this will be explicitly mentioned in the offer.

To place an order on our website, you need to create an account. Your log-in name will be your e-mail address, and you will need to choose your own security password. Your personal details will be stored behind your log-in name and password, and can only be accessed and changed by you. As soon as you have a log-in name and a password, you can place an order. You can select your products before registering, but before checking out, you will need to go through the registration process.

Once you have registered, if you wish to place an order, select the goods, choose the colour and size you want, and press "Add to basket" button. When you have finished shopping, click on the "Place my order" button. This starts the payment process. Check your basket summary carefully, choose your delivery method, make sure to type in the address you want your order to be delivered to and proceed to payment, using the payment method you want among the different options.

Your order history will be detailed in your account for future reference.

Once you have placed an order, it will be confirmed by email. Please check your order and the confirmation thoroughly. It is important that you give a correct and personal email address when you register in order to avoid errors. Please make sure that your SPAM filter does not prevent you from getting our messages.

When placing an order, you have agreed that these Terms and Conditions apply to such order.

Orders placed before 9am (Monday to Friday), will be processed and sent out on the same day.

Orders placed after 9am (Monday to Friday), will be processed and sent out on the following day.

Orders placed on a Saturday and Sunday will be processed on the following Monday.

When your order has been shipped, we will send you a dispatch confirmation by email. This will include a tracking number for your parcel so you can track its progress. You can also log in to see your order details and delivery status.

We send the goods that you have ordered from our French warehouse, through DPD and DHL. The place of delivery is deemed to be the shipping/delivery address that you provide in your order.

We aim to process and dispatch all orders within 24 hours, however this can take longer in periods of high demand. Delivery will take 5-7 working days to most UK mainland addresses.

When multiple items are ordered, one of them might not be immediately available. In this case, we will inform you of the delay before we have those products back in stock. If the delay is short (typically a few days), we will wait for the item to come back in stock before we ship out your parcel. If the delay is longer, we will send your order in several parcels. In both cases, you will receive an email informing you of the current status of your order and its products.

If you are not at home during the day that will not be a problem: we will deliver your order wherever you want such as a work address. In this case, it is important that you give the correct shipping address when placing the order. Please note it's not possible to have your order delivered to a P.O. Box.

If the goods are lost or damaged in transit, please let us know promptly, so that we can make a claim against the carrier. We will offer you the choice of a replacement or a full refund. Please see Returns Policy for further details.

This cancellation policy does not affect your rights when we are at fault : for example, if goods are sent out in error, faulty or mis-described.

You have a legal right to cancel your contract before delivery and up to 14 working days after delivery. To do this, please email us or write to us to discuss the matter further.
 

Cancelled orders must be returned to us in an unused condition. If goods are failed to be returned to us, we will collect them, and we will charge you the direct cost of the collection.

In the event that the wrong items have been sent to you, we will refund the amount you paid for your purchase, your original shipping costs and any costs incurred on your behalf for the return of the wrong item within 14 days of receiving the product in our office, or when proof of return is given, whichever is earliest.

 

Nota bene: Perishables, dried goods and food items cannot be returned or exchanged for food security reason. These items are not eligible to any refund.

12.1 : Returning your entire order

 

You have the right to return your entire order up to 14 days from receiving the products.

When returning your entire order, you will receive a refund for the order you have returned and your original shipping costs. Refunds will be processed within 14 days of you returning the items to us or evidence that they were returned.

Return postage costs, in this case, will be the responsibility of the customer.

12.2 : Returning part of your order

You have the right to return part of your order up to 14 days from receiving the products.

When returning part of your order you will receive a refund for the products you have returned to us within 14 days of sending the item back to us or evidence that it was returned.

12.3 : Returning Faulty Goods

If you receive your goods and there is a problem please, contact us to discuss the matter further. In the first instance, we will ask you to provide images along with a description of the fault to aid our team in their assessment.

If the goods are found to be faulty within a reasonable time frame of receiving the items then you may reject them and claim a full refund. If the fault is found later on, or if there is a delay in making a complaint, you will still be entitled to a repair, or if a repair cannot be done without causing inconvenience, a replacement. If a replacement is not available, you may claim a part or full refund for the faulty goods.

When returning a faulty product to us (if after being assessed its considered to be faulty), your return postage costs will also be refunded to you. Please ensure you supply us with proof of return postage in this instance.

Please note: No claim for faulty goods can be made if any of the following applies : damage caused deliberately or through negligence, improper use or careless maintenance, normal wear and tear, damage caused by not following the care instructions correctly.

12.4 : Return process

We will refund you, in line with our returns policy, within 14 days of the goods being returned.

12.5 : Exchanges

If you wish to exchange an item, please get in touch with our customer service first. We will then ask you to return your order to the above address, and as soon as we've received your goods, your new order will be prepared and dispatched.

12.6 : Extended Christmas returns policy

We’ve extended our usual limit date for returns. Any purchases made online between 28 November 2023 and 24 December 2023 can be returned up until 31 January 2024. For purchases made from 25 December 2023 onwards, our normal refund policy will apply. Perishable goods and foodstuffs are not eligible for returns.

We do our upmost to provide you with the best information, products and services possible. If you do have a complaint or any comments to make, please contact us by telephone, email or post at the earliest possibility clearly explaining the situation. We will reply to your message as soon as we can.

Customer satisfaction is very important to us, therefore if you've had a problem with your online purchase, we will do all we can to resolve this. If you feel you have a problem that hasn't been resolved, you can try the Online Dispute Resolution Platform ( https://ec.europa.eu/odr ).

You agree to pay compensation to us and our agents and officers, directors and employees, immediately on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of these Terms and Conditions by you. We may terminate your use of the website immediately if we consider that you have breached these Terms and Conditions.

These Terms and Conditions and all matters connected with any order you place on our website are governed by English law, and you agree to submit to the exclusive jurisdiction of the English courts in relation to all matters connected with, or arising out of, the website or any order you place on the website.

All dealings between us in connection with our T&C's and each purchase shall be carried on in the English language.

You may not transfer any of your rights or obligations under these Terms to another person without our prior written consent, which we will not withhold unreasonably. We can transfer all or any of our rights and obligations under these Terms to another organisation, but this will not affect your rights under these Terms.
