Extract from the CNIL (French DPA): Conditions for obtaining the customer's consent for the creation of a payment account.

When card data is kept by the e-merchant to offer an additional service to the customer, such as not having to re-enter his or her card number when making a subsequent purchase, the person's prior consent is mandatory. This cannot be presumed and must take the form of an explicit act of will, for example by means of a box to be ticked and not pre-ticked by default. Acceptance of the general terms of use or sale is not considered to be a sufficient means of obtaining consent. The CNIL (French DPA) also recommends that the e-merchant should include a simple means of withdrawing consent, free of charge, directly on its commercial site.
